Important information
By making a reservation at Lagniappe, Guest agrees that Guest and Guest’s party will abide by these Rules and Regulations, as well as any other Rules and Regulations posted in the Guidebook or on the property. Should Guest violate these rules, Owner reserves the right to cancel this rental immediately with no refund due to Guest. Thank you in advance for your understanding and compliance with the rules.
1. For reservations of 30 days or longer, a separate cancellation policy applies:
- Guests will receive a full refund if they cancel at least 30 days before the scheduled check-in date.
- A 50% refund will be issued for cancellations made between 14 and 29 days prior to the scheduled check-in date.
- No refund will be provided for cancellations made 13 days or fewer before the scheduled check-in date.
2. Property. The property is furnished and includes household appliances, furnishings, decorations, artwork, linens, towels, kitchenware, audio/video equipment and personal property.
3. Rental Party/Maximum Occupancy: The rental party shall be limited to the number listed on the rental reservation. The maximum number of guests is limited to 8 persons for Lagniappe, unless specific written exemption has been made by Owner. An additional charge of $100 minimum per person per night for guests in addition to above guests may be assessed.
4. At all times during said rental period, Guest agrees to have no more than the allowed number of guests for occupancy, (including children). If more than the stated number of guests are found to be occupying the unit, without prior written permission, Owner has the right to terminate this contract and Guest will forfeit all monies paid, including rent, cleaning, and deposits.
5. No 3rd party reservations.
6. Term of the Lease. The rental period begins at 4pm on the dates in the reservation and will end at 10am, on the check out date. Check in time is 4pm and check out time is 10am. Guest will be given a code for the key pad on the door, for private access to the cabin. The code will be provided to you upon reservation.
7. Noise: Guest understands and agrees that they, and all members of their rental party will be respectful to our neighbors, including, driving slowly on the road to the property, not creating any noise (including music) which the neighbors can hear, especially in the evening and during the night. Kindly keep the noise at a minimum after 10:00 pm. Any violation of this rental agreement and Guest will be required to leave immediately, with no refund for any unused rental time.
8. Access: Guest shall allow Owner access to the property for purposes of repair and inspection. Owner shall exercise this right of access in a reasonable manner.
9. Rental Rate and Fees: The rental rate shall be as stated on booking platform.
10. Damages: Guest must report any damages to Owner.
11. Guest must provide us with a valid ID that matches their credit card information
12. Guest must provide us with a valid working phone number & guests listed on the reservation must report to us within 2 hours from the time of arrival if anything in regards to cleanliness does not meet their standards so we can help address the situation as soon as possible
13. Late check-out fee of $50 (if not authorized) applies for check-outs after 10:00 am. We're sorry we have to charge this but we pay our housekeepers based on the agreed-upon checkout time and if they are unable to clean we still have to pay them
14. No campers/RVs allowed.
15. Thermostats should be set no higher than 80 degrees and no lower than 68 degrees for the protection of the contents of the cabin.
16. Condition of Property: Guest shall return the premises in the same condition as received. As a part of the rental agreement, Guest will pay $198 cleaning fee which includes normal “turn” cleaning. Guest agrees they will be responsible for excessive additional cleaning if needed, and hereby agrees to have excessive cleaning deducted from their security deposit, at Owner’s sole discretion. Guest also agrees to leave the property in good condition with all items, furniture, etc in the same places where they found them upon move in.
17. Cancellation Policy: Guests are advised that cancellation policy shall be enforced as described on the booking platform.
18. Please remember to take all of your belongings with you upon checkout. Any items left behind will incur a $50 Mailing fee (separate from the cost of postage). We will do our best to send your items back to you within a week
19. No Assignment or Subletting: This Agreement shall not be assigned, nor the premises sublet without the prior written consent of the Owner. Guest acknowledges that they will personally occupy the property for the entire lease or rental period and will not sublet any portion of the property. Violation of these terms shall give Owner the right to immediately evict Guest and terminate this Agreement, and Guest will forfeit any right of return of any monies paid to date including any security deposit.
20. Indemnification: Guest agrees to indemnify Owner and Owner’s Agent and save Owner and Owner’s Agent from and against any and all claims, damages, liabilities and expenses, including reasonable attorney’s fees in connection with the loss of life, personal injury, illness, and/or damage to the property arising from or out of any occurrence in, upon, or about the premises, occasioned by an act or omission by Owner, Owner’s Agent, Guest or other occupants.
21. OWNER and OWNER’S AGENT SHALL HAVE NO LIABILITY FOR DAMAGES OR INJURY to Guest or Guests: It is expressly understood an agreed that Owner and Owner’s Agent will not be liable for any damages or injury to Guest or other occupants and their property from whatever cause arising from the occupancy of said premises, both inside and outside of the house, whether on the property or elsewhere.
22. THE SUPERVISION AND SAFETY OF ALL CHILDREN ARE THE DIRECT RESPONSIBILITY OF GUEST OR PARENTS, OR CARETAKERS OF ANY CHILDREN ON THE PREMISES, but not limited to decks, balconies, hot tub and any and all other activities on the premises.
23. Guest specifically accepts ALL liability for use of hot tub on the property and understands that Owner and Owner’s Agent shall have no liability from any accidents, injuries, or death that may result from the proper or improper use of said hot tub. Guest accepts said liability by voluntary use of said hot tub.
24. The Guest understands and agrees that the Owner and/or Owner’s Agent of Lagniappe are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. Guest specifically indemnifies and holds the Owner and Owner’s Agent harmless for any liability. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premises. If all guests on this reservation do not personally sign this waiver of liability, then the primary renter accepts liability for all guests and hereby waives any Owner or Owner Agent liability on their behalf.
25. Excessively dirty units will incur an additional cleaning fee and will be evidenced with photos
26. For your security and protection the property is equipped with an exterior camera
27. Owners have locked closets for their personal possessions and extras for the rental. These closets are private and are not to be opened by tenants or guests under any circumstances.
28. Owner and/or Owner’s Agent are not responsible for the loss of personal belongings or valuables of the guest.
29. People other than those in the Guest party set forth in the Rental Agreement may not stay overnight in the property. The property shall not be used for gatherings of any kind for anyone other than registered Guests (i.e. dinner parties, weddings, etc.) without advance express written permission by the Owner.
30. Guest promises to only use appliances and amenities of the vacation rental for their intended uses.
31. Children: Lagniappe is family friendly and welcomes well-behaved children who are respectful of the property. Parents hereby agree to supervise their children both indoors and outdoors, especially in and around the hot tub and balcony areas.
32. Fireplace: Do not put anything in the fireplace. Do not touch the controls for the fireplace except for the timer on the wall to the right. If you turn off the pilot light we will have to charge a $50 service call to turn it back on. Please keep children away from the front of the fireplace. The fireplace is shut down from April 1 to October 1.
33. Plumbing: The septic system is very effective; however, it will clog if improper material is flushed. DO NOT FLUSH anything other than toilet paper, including wipes. No feminine products should be flushed at any time. If there is a clog in the system, Guest will be charged damages accordingly.
34. Hot Tub: Guest understands that a hot tub is available on the property for their private use. Guest assumes any and all liability from us of said hot tub. Guest is aware that consuming alcoholic beverages while in the hot tub increases the alcoholic effect of the alcohol. Guest will keep the hot tub closed with the cover when not in use, and will supervise any children when using the hot tub. By using the hot tub, Guest agrees to assume all liability from said use and hereby indemnifies Owner. Hot tub cover is to be kept on hot tub when not in use. Do not sit or stand on hot tub cover. If hot tub cover is damaged Guest is responsible for replacement.
35. Weather: Lagniappe is located in a mountain setting. While the road is typically clear and accessible in any vehicle, winter weather is possible during certain months. We love the snow but local roads can be snow covered, curvy and steep. Owner highly recommends four wheel drive and/or chains during winter events, and cannot refund anything due to road conditions or power outages caused by inclement weather. Travel insurance is recommended.
36. FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.
37. STORM POLICY/ROAD CONDITIONS: No refunds will be given for storms. If your vacation is during the winter months, please come prepared to drive in snow and/or ice to reach your rental property. We do not refund due to road conditions.
38. WINTER CONDITIONS: Tenants/Guests are notified that this cabin is in a mountain location where winter conditions may apply. Walkways, driveways, sidewalks, stairs, etc…may be slippery due to ice and snow. These areas may be slippery even when they do not appear to be. It is advised that caution be used. Please step carefully on all outdoor surfaces. It is further advised that shoes be removed upon entering the cabin as wet or icy soles can cause slippery conditions on floors inside the cabin.
39. Pets: No pets are permitted at Lagniappe at any time, not even visiting pets, inside or outside. If you violate this you will be charged an additional $250 and your reservation will be cancelled and you will be asked to leave.
40. Service Animals & ESAs: According to the ADA, a Service Animal is defined as any dog individually trained to work or perform tasks for the benefit of an individual with a disability, including, but not limited to, guiding individuals with impaired vision, alerting individuals to an impending seizure or protecting individuals during one, and alerting individuals who are hearing impaired to intruders, or pulling a wheelchair and fetching dropped items. Under the ADA, Emotional Support Animals (ESAs) or “comfort animals” (whose sole function is to provide comfort or emotional support) are no longer considered service animals. This is considered a pet and as such is NOT ALLOWED at this cabin.
A person with a disability uses a service animal as an auxiliary aid. In compliance with the ADA, service animals are welcome at Lagniappe.
Lagniappe’s guests that require a Service Animal for a disability must register the service animal with our reservations department prior to your visit just as you would with any other guest in your group.
**Requirements of Service Animals and their owners include**
• All animals need to be immunized against rabies and other diseases common to that type of animal. All vaccinations must be current.
• Animals must be in good health.
• The owner must be in full control of the animal at all times. The care and supervision of the animal is solely the responsibility of the owner/partner.
• The owner/partner must provide Lagniappe with the following information upon registration:
• Is the dog a service animal required because of a disability
• What work or task the dog has been trained to perform
• What kind of animal is your Service Animal
Reasonable behavior is expected from Service Animals while on Lagniappe’s property. Lagniappe reserves the right to charge its customers if a Service Animal causes damage or cleaning complications, as it is our regular practice to charge all customers for the same types of damages. Example: Lagniappe can charge a guest with a Service Animal for the cost of repairing or cleaning items damaged by the service animal, just as we would charge other guests that cause damage during their reservation. The owners of disruptive and aggressive service animals may be asked to remove them from Lagniappe’s facilities.
Cleanliness of the service animal is mandatory. Consideration of others must be taken into account when providing maintenance and hygiene of service animals. The owner/partner is expected to clean and dispose of all animal waste
41. Smoking: This is a NON SMOKING cabin, and includes the use of vape pens and marijuana. If you smoke inside the cabin you will be charged $250, plus the increase in cleaning fees, plus any damages.
42. Alcoholic Beverages & Drugs: Guest agrees that there will be no illegal activities on the premises, including but not limited to: possession, serving or consumption of alcoholic beverages by anyone under the age of 21; or the possession or use of any illegal drugs.
Additionally, Guest accepts full responsibility and liability and hereby indemnifies Owner and/or Owner’s agents for anything that happens in reference to Guest and/or Guest’s party partaking of any alcoholic beverages or drugs on the property.
43. Fireworks: Although fireworks may be legal in Tennessee, they are not permitted at Lagniappe at any time. Absolutely NO fires! Fires are not permitted except for the provided charcoal BBQ grill. Unauthorized fires (including candles, incense, or sage) will be charged $150, plus damages.
44. Trash Disposal: There is no trash pickup service at the cabin. All trash is removed by the cleaner after checkout. Guests are asked to crush and compact trash as much as possible so it fits into the provided trash bags. If trash removal service is requested prior to checkout, a $45 service fee will apply.
45. Entire Agreement: This rental agreement and house rules constitute the entire agreement between the parties. No oral statements shall be binding. This agreement may only be amended by a written document duly executed by all parties. It is the intention of the parties that if any portion of this Agreement is invalid for any reason, such invalidity shall not void the remainder of the Rental Agreement.
46. GUEST ACKNOWLEDGES THAT THEY HAVE REVIEWED AND UNDERSTOOD THE TERMS OF THIS AGREEMENT and the Rules and Regulations attached, and agree to be bound by them.
47. Guest and Owner acknowledge that this document is available for review on the booking platform and is implied that this Agreement is legally binding acceptance of all terms and conditions, the same as if Guest had actually executed the Agreement in person.
48. If not following any of our rules forces us to refund or discount an upcoming or existing guest you will be liable for the costs
49. If you were a previous/current guest and did not respect our house rules and our property, we have the right to decline your next reservation.
50. Guests who fail to arrive for their reservation, for any reason, will be considered no-shows. No-shows are non-refundable, and no credits, reschedules, or exceptions will be provided under any circumstances.
51 As part of our commitment to maintaining a clean and comfortable environment for all guests, we require a midterm cleaning for reservations lasting 30 days or longer. The midterm cleaning will take place on the 15th day of your reservation. This cleaning is mandatory and is designed to ensure the continued cleanliness and hygiene of the property.
52. The cleaning fee for the required mid-stay cleaning will be deducted from your security deposit, if a deposit was collected. If you booked through Airbnb, the charge will be processed through the Airbnb Resolution Center. For reservations made through other platforms, the fee will be collected according to the payment method associated with your booking.
